The airline told CNN that the union’s statement “does not affect Southwest’s operation or our ability to take care of our Customer.” The union also said it is asking Southwest for “gratitude pay to compensate our pilots who suffered through the meltdown.” Even at the end of that 90-day period a vote from Congress can impose a contract on the two sides and block a strike, as happened at the nation’s freight railroads in December. Under the law a strike typically can’t start until 90 days after a government agency known as the National Mediation Board declares that the two sides are at an impasse. That law imposes strict restrictions on when airline employees are allowed to strike. Airline employees work under the Railway Labor Act, a different labor law than the one that controls contract negotiations at most businesses. Still, there is little chance of a strike anytime soon. The union’s vice president, Michael Santoro, called it “a tool to wake up management.” It said the vote could begin in May, a timeline that would “give our customers time to book elsewhere so that they may have confidence in their summer vacations, honeymoons, and family outings.” The union leadership is calling for a strike authorization vote, an early step towards a possible strike. "Gary Kelly still reigns supreme on the board of this Company despite having overseen the decisions and setting the conditions that made this most recent fiasco possible," Nekouei wrote, adding that the airline's struggles are "not a Southwest Airlines problem. This is not an employees of Southwest Airlines problem. This is not an unprecedented weather problem. This is a Gary Kelly problem." Kelly served as Southwest CEO from 2004 until last February, and replaced Southwest co-founder Herb Kelleher as chairman in 2008. Nekouei laid the blame on Southwest chairman and former CEO Gary Kelly. Those include a series of “meltdowns” at Chicago Midway International Airport in January 2014, leading to 130 flights there being canceled a router brownout issue in July 2016 that caused 2,300 flights to be canceled and an October 2021 air traffic control problem in Jacksonville that led to 29% of Southwest’s flights being delayed or canceled. Since 1978, the Southwest Airlines Pilots Association (SWAPA) has been the sole bargaining unit for more than 10,000 Pilots of Southwest Airlines. Nekouei says systemwide meltdowns at Southwest Airlines have increased in frequency and magnitude over the past 15 years, citing not just the December failures that left Southwest passengers stranded nationwide, but also incidents from years past.
